Saftey In Private Spaces Policy

Purpose: To comply with the State Board of Education rule 6E-7.001, Florida Administrative Code (F.A.C.), Designation of Restrooms and Changing Facilities in Private Postsecondary Education Institutions. It is the Academy for Nursing and Health Occupations’ (ANHO) responsibility as a licensed college or institution (as defined in section 1005.02(4), Florida Statutes (F.S.)) to provide requirements regarding restroom and changing facilities at college and universities licensed by the Commission for Independent Education and at institutions not under the jurisdiction or purview of the commission, as identified in s.1005.06(1)(b)-(f), Florida Statutes (F.S.) pursuant to s.553.865, F.S.

Overview: As of July 1, 2023, all CIE-licensed colleges and universities and institutions not under the jurisdiction or purview of the commission as identified in Section 1005.06(b)-(f), F.S., must ensure that (a) restrooms are designated for exclusive use by males or females, as defined in Section 553.865 (3), F.S. or that there is a unisex restroom; and (b) that changing facilities are designated for exclusive use by males or females, as defined in Section 553.865 (3), F.S., or that there is a unisex changing facility.

ANHO Compliance:
This policy pertains to the use of restrooms and changing facilities by males or females based on biological sex at birth. This includes, but is not limited to, the following:

1. Restrooms are designated for exclusive use by males or females based on biological sex at birth and there is a unisex restroom.
2. There are no changing facilities at ANHO.
3. Students, employees and visitors must comply with s. 553.865, F.S.
4. If it is determined, that a student, employee, or visitor uses a restroom contrary to their biological sex rather than using the designated unisex restroom, that person will be asked to leave immediately.
5. In the event that a student, employee or visitor is asked to leave the restroom and fails to comply, a police non-emergency call will be made. In the event the individual refuses to comply with this policy, the police will be asked to escort the individual out of the building.
6. Violation of the Safety in Private Spaces Policy may result in disciplinary action up to and including termination.
7. A student, employee, visitor, or law enforcement has the right to file a complaint with the Attorney General alleging that the institution has failed to meet the minimum requirements for restrooms and changing facilities under sections 553.865(4) and (5). F.S.

For purposes of this policy, a person may only enter a restroom or changing facility designated for the opposite sex under the following circumstances:

1. To accompany a person of the opposite sex for the purpose of assisting or chaperoning a child under the age of 12, an elderly person as defined in s. 825.101, or a person with a disability as defined in s. 760.22 or a developmental disability as defined in s. 393.063;
2. For law enforcement or governmental regulatory purposes;For the purpose of rendering emergency medical assistance or to intervene in any other emergency situation where the health or safety of another person is at risk;
3. For custodial, maintenance, or inspection purposes, provided that the restroom or changing facility is not in use;
4. If the appropriate designated restroom or changing facility is out of order or under repair and the restroom or changing facility designated for the opposite sex contains no person of the opposite sex.
